BUYER SERVICES BUYING PROPERTY Communicating by Phone: I try to answer my phone when it rings. When I am with another client, in a meeting, or not available, you should leave me a voice message with your name and phone number. I will return your call as soon as possible.
Communicating by Email: I try to check my email several times each day and make every effort to reply quickly. Leave a brief message about your real estate needs and the best way to reply back to you, email or phone.
Listening to You and Analyzing Your Situation: Tell me about your real estate needs or desires. The more detailed information you give me, the better I can search for appropriate properties. The more you tell me about your situation the better I can assist you with the entire buying process.
Providing Local Market Data: I will provide you with overall market conditions and inform you about local real estate practices, procedures, and traditions. My MLS (Multiple Listing Service) is a treasure-trove of current and historical information that can help you to obtain the right property for the right price.
Qualifying for a Loan: One of the first steps to buying residential real estate (single-family detached home or condominium) is to be qualified or approved for financing by a lender before you find the home of your choice. A Letter of Qualification or a Letter of Approval gives you negotiating power with sellers. They know you are serious and have the ability to close the deal. They usually will be more willing to work with you on price, conditions, terms, and timing. How Much Home Can You Afford Comparing and Analyzing Mortgage Loans: Unless you already have an excellent relationship with a lender (bank, credit union, or mortgage company), it is best to shop around to find the best financing deal. Different lenders have different programs, charge different fees, and may even have different interest rates and terms. I will help you to compare several loans to find out which one fits your financial situation.
Searching for and Showing Properties: I will search my MLS, neighboring MLS's, pocket listings, and talk to other agents and brokers to find you suitable properties. Detailed information sheets, photos, tax rolls, and other available data can be emailed, faxed, or mailed to you. Study them at your leisure. When you have chosen the most interesting properties, I will arrange to show them to you in person. Vacant homes or buildings and land can be shown at any time. Occupied dwellings may need appointments. I will try to arrange all showings to meet your schedule.
Preparing and Presenting an Offer: When you have decided to make an offer for a property, I will explain all of the required paperwork, including GACAR and FAR documents. You will receive the Seller's Real Property Disclosure, the Community Summary Disclosure Form, and sometimes other disclosures from the seller. Your offer usually will include a Purchase & Sale Agreement, a Comprehensive Addendum, and other appropriate Addendums and Riders. I will make sure your offer is accurately presented to the seller in a timely manner. In cases where you want to buy one of my listings I will present your offer to the seller myself. When you are buying another agent's listing I will make them aware of all aspects of your offer.
Escrow (Binder) Deposit: It is customary to include an escrow (binder) deposit with your offer to show the seller that you are serious. Your binder will usually be deposited into the Eyemark Realty, Inc. Escrow Account. Sometimes, if the seller insists, your deposit will be deposited into the escrow or trust account of an attorney (lawyer) or title company. In either case it will stay in escrow until closing or returned to you if the deal falls through. When your purchase closes, your deposit will be applied to your down payment. When the purchase doesn't close due to unmet contigencies in the contract, your deposit will be returned to you. However, if the purchase doesn't close because of nonperformance by you, then the deposit will be claimed by the seller as liquidated damages.
Negotiating with Sellers: It is your choice whether to make your own decisions or whether to avail yourself of my knowledge and experience. In either case I will act as the intermediary between you and the seller or the seller's real estate agent. When I am acting as your negotiator I will strive to obtain the best price, conditions, terms, and timing that is possible for your purchase. Sometimes a negotiation will go back and forth several times before a contract is executed. However, realize that sometimes sellers might be emotionally attached to their property and won't pay attention to current market data. It is not always possible to strike the deal you want. When compromise and concessions fail it is usually better to continue searching than settle for a deal you will regret later.
Sale Pending (Under Contract) Period: After a contract (agreement) has been executed by both the buyer and the seller the property status becomes Sale Pending or Under Contract. During this time you will be required to finalize your financing with your lender's processor and underwriter. You will be required to do your inspections, pay for an appraisal, and obtain a survey. I will be relaying information to and from your lender, arranging inspections and analyzing their results, ordering a survey, and communicating with the closing agent.
LEGWORK: During all phases of your real estate buying process there will be documents to send and receive, arrangements to be made, and people to meet. I will be handling these items in person, by telephone, by email, by fax, by FedEx, by UPS, and by U.S. Mail.
The Closing: You become the owner of the property at the closing. This is when the money changes hands and all of the final paperwork is signed by the buyer and the seller. The closing agent, an attorney or title company agent, collects your down payment and receives your loan money from your lender, and disburses funds to the seller, the seller's lender, and others who are due payments or commissions from the sale. A deed is prepared and recorded in the county (public) records after the closing. This gives you legal ownership of the property.
Follow-Up Assistance After the Closing: You can contact me with questions no matter how much time has passed since your closing. I keep copies of your documents on file or know who to contact to obtain copies in case you misplace something. If you purchased a primary residence, I will accompany you to the county property appraiser's office to file for Homestead Exemption.
